Telekom-Pläne: Landgericht Köln verhindert Drosselung von DSL-Flatrates

Anfang des Jahres sorgte die Telekom mit der Veröffentlichung von Plänen für Aufsehen, wonach man plant, ab 2016 DSL-Verbindungen nach dem Erreichen einer gewissen Datenmenge in der Geschwindigkeit zu drosseln. Diese Pläne sorgten für reichlich Unmut bei Kunden und Internetaktivisten. Selbst die Verbraucherzentrale Nordrhein-Westfalen schaltete sich ein und mahnte die Telekom wegen ihrer Pläne ab. Die Telekom reagierte auf die Kritik und verkündete schließlich, dass die Geschwindigkeit nicht auf die ursprünglich geplanten 384 Kbit/s, sondern auf 2 MBit/s drosseln werde, womit eine Grundversorgung für den normalen Nutzer nach wie vor gegeben wäre.

Nun allerdings hat sich das Kölner Landgericht eingeschaltet und in einem Urteil zu dem Thema verkündet, dass Kunden mit dem Begriff "Flatrate" nicht ein bestimmtes Datenkontingent, sondern für einen Festpreis eine bestimmte, erworbene Geschwindigkeit verbindet. Dies träfe auch nach wie vor bei einer Drosselung auf 2 Mbit/s zu. Damit stimmt das Gericht in weiten Teilen der Argumentation der Verbraucherzentrale NRW zu. 

Dieses Urteil könnte damit auch Signalwirkung haben. Unter Umständen wird sich die Tarifstruktur bei den deutschen DSL-Verträgen hierdurch dahingehend ändern, als dass künftig wieder mehr Volumentarife und Flatrates nur im höherpreisigen Segment angeboten werden. Inwieweit sich dies auch auf Smartphone-Verträge auswirkt, muss sicherlich abgewartet werden. Hier ist die Drosselung der Geschwindigkeit, trotz der Verwendung des Begriffs "Flatrate" nach wie vor gang und gäbe.

Viel schlauer wäre es, jetzt dafür zu sorgen, dass sich die Telekom auf die Netzte anderer Betreiber, insbesondere Kabelnetzbetreiber, gegen Miete aufschalten darf.

Um es mal voeweg zu sagen: Ich hab mit der ganzen Branche aber auch gar nichts zu tun und wirklich prickelnd finde ich eine Drosselung auch nicht, aber:
Fakt ist doch, dass das Volumen der Internetnutzung in den vergangenen Jahren immer weiter gestiegen ist und irgendjemand ja auch dafür bezahlen muss. Ich will jetzt nicht so auf die K... hauen, aber ich hab mit Akustikkopplern (Gummipräser über den Lautsprecher des Telefons...) angefangen zu surfen und ich weiss den Speed gar nicht mehr (14kbit, oder so... Und das war seinerzeit ganz schön teuer (und zwar richtig!). Da wurden Downloads von 1MB zum Geduldsspiel und gingen darüber hinaus richtig ins Geld (die hat dann einer gemacht und die auf Diskette verteilt).
Zwischenzeitlich leisten die Netze erheblich mehr und alles wird über Internet übertragen. HD Content, youtube, Betriebssysteme und was auch immer.
Letztendlich ist jedoch Fakt, dass das ja irgendeiner bezahlen muss und das ist konsequenterweise der, der es benutzt?!
Fakt ist doch, dass entstandene Kosten getragen werden müssen. Und derzeit ist es halt so, dass z.B. mein alter Herr (der vielleicht im Monat 200 MB Traffic verursacht) genau so viel zahlt, wie ich (ich denke mal, dass ich im Festnetz bei ca. 50-100 GB liege - je nach dem- keine Ahnung...).
Was ich damit sagen will: Es gibt Pläne, verursachergerecht abzurechnen, und das ist ja auch OK der Tanke bezahle ich ja auch, was ich getankt habe und nicht die km, die ich damit gefahren bin...
Und jetzt prügelt gerne auf mich ein!

Es geht hauptsächlich um den Begriff "Flatrate". Diesen nutzt die Telekom weiterhin, obwohl nach einer bestimmten Volumen die Geschwindigkeit gedrosselt wird. Das ist meines Wissens nach dann keine "Flatrate" mehr.
