K(l)eine Rolle rückwärts: Telekom rückt von Drosselung von Flatrates ab

Die Telekom hat mit der Ankündigung, eine Drosselung für DSL-Flatrates einführen zu wollen Anfang des Jahres für einen Paukenschlag gesorgt. Entrüstungsstürme, Abmahnungen und halbherzige Erklärungsversuche inklusive. Nachdem das Landgericht Köln Ende Oktober in einem Urteil zu dem Thema verkündet hatte, dass Kunden mit dem Begriff "Flatrate" nicht ein bestimmtes Datenkontingent, sondern für einen Festpreis eine bestimmte, erworbene Geschwindigkeit verbindet und damit quasi die Telekom-Pläne gestoppt hatte, knickt die Telekom an dieser Stelle nun ein. Zumindest ein wenig. Wie Telekom-Deutschlandchef Niek Jan van Damme heute bekannt gab, wird der rosa Riese vorläufig auf auf die Drosselung verzichten. Man wird nun die AGBs bis zum 05. Dezember entsprechend anpassen und die Drossel-Klausel aus den Pauschal-Tarifen Call&Surf und Entertain entfernen. Dies gilt auch für Kunden, die in den vergangenen Monaten bereits einen Vertrag abgschelossen hatten, der die Drossel-Klausel enthielt.

Letzten Endes war dies aber vorhersehbar und in ähnlicher Form bereits vor Wochen angekündigt worden. Künftig wird man sich wohl darauf einstellen müssen, dass es eine Unterscheidung zwischen (entsprechend teuren) Flatrate-Tarifen und (günstigeren, aber ab einem gewissen Kontingent gedrosselten) Volumentarife geben wird. Diese wird die Telekom aber laut van Damme aus technischen Gründen frühestens 2015 beginnen einzuführen. Zusammengefasst geht es bei all dem lediglich um die Begrifflichkeit der Flatrate. Diese bleibt auch künftig ungedrosselt, dürfte jedoch teurer werden. Innerhalb der Volumentarife werden dann die ursprünglichen Drosselpläne ab 2015 umgesetzt.

Es wäre schön, wenn eine unabhängige Stelle die Notwendigkeit einer Preiserhöhung verdeutlichen könnte.
Vlt. ist es ja technisch/organisatorisch mit den immer weiter steigenden Transferraten nicht mehr tragbar?

Gilt das Urteil auch für Mobilfunkverträge?
Vodafone hat mir heute auf Anfrage mitgeteilt, dass nach 2GB immer (auch Flatrate) gedrosselt wird.
War wohl schon immer so (lt. Aussage bei allen Anbietern) und bleibt deshalb auch so.
Nach meiner Rechtsauffassung ist diese Praxis nach dem Urteil nicht statthaft.

Das Urteil bezieht sich auf Flatrates im Festnetz nicht im Mobilfunk, hier gab es schon immer diese Klausel das ab einem bestimmten Verbrauch die Geschwindigkeit auf GPRS Niveau gedrosselt wird.
